Terms Of Sale-  These Terms Apply To All Sales.

The terms of sale include but are not limited to the following and are subject to change at any time. Please check here often for the most current information. Revised 5-15-09

All kits are made to order for each customer because I'm a small business and don't keep a lot of inventory on hand. With that in mind please note the following:

  • Know what you are buying. There are very accurate descriptions and pictures available for everything I sell unless it's a new release still being made. I offer kits, almost ready to fly planes and custom building. Kits will take a lot of work to complete. If you have any questions please ask before buying.

  • I don't typically accept returns or offer refunds of any kind once your order is placed. I provide enough pictures and data on this site to make an informed decision about what you are buying. If you don't understand something or need more information, please ask before buying.

  • When purchasing an ARF from us, understand that they are highly complex and built here in the USA. This takes time. If for any reason you are not willing to wait and have placed a deposit, you can receive a kit or kits from us to cover your deposit amount since I do not typically do refunds but I will do house credit. Example, you place a $1,000 deposit on an ARF, but decide after the fact that you cannot afford the ARF or your situation changes. I will provide you with a kit or merchandise worth your $1,000 deposit rather than a refund.

  • Regarding deposits place on planes in pre-production- The full purchase price is due 30 days before shipping minus your deposit. If there is a delay in making the final payment, your shipping date could also be delayed.

  • My typical production time is 6-8 weeks (or whatever is stated on the page of the aircraft you are buying, if longer), sometimes more depending upon the volume of orders I have standing. I will give you a projected shipping date when you place your order.

  • I have never missed a promised shipping date. I will make every effort to stick to any promised shipping date, however, if I have an issue with a supplier or something else beyond my control I may have to extend the shipping date. If this happens you will be notified of the delay immediately.

  • Shipping is always at cost plus a small crating charge, paid before it is shipped.

  • Regarding crating fees- I know a crating fee may seem silly to some of you but consider this: If I crate it, it costs me money and supplies aren't cheap to build a good crate to protect these planes. Sure, I could build that cost into the cost of the airplane, but is that fair to the guys who pick their planes up at the factory? No! If I was a local buyer I wouldn't want to pay more for my plane to subsidize shipping someone else's plane. Remember guys I operate on a smaller margin than most of the big players out there so I try hard to make it fair for everyone and I believe a crating fee is fair, if you need a crate.

  • On large shipments that must go by truck, I prefer and highly recommend you set up your own shipping so you know exactly what to expect and who to call in case of any delays or damages.

Liability Disclaimer

  • Flying remote control airplanes can cause serious injury and or death. If you don't already know how to fly, don't try to teach yourself. Seek qualified help to train you before you attempt to fly solo.

  • Pence Aviation has no control over how you assemble, modify and use our products, thus we assume no responsibility for any damages or injuries caused by the assembly, use or misuse of our products.

  • All of our products including kits, "almost ready to fly" and ready to fly aircraft are sold with the express understanding that, just as with real airplanes, you the pilot are the final authority as to the airworthiness of the aircraft you intend to fly. Pence Aviation does not "certify" any of it's products as "airworthy" when shipped even if they have been flown previously.

  • I stand by my products, but they usually must be shipped great distances, therefore it is the buyers responsibility to inspect the structure, controls etc of the aircraft etc and make any needed adjustments upon receipt. Check carefully for shipping damages and file a claim with the carrier if needed.
